Inquiries and service agreements

Submitting a form, sending an email, or requesting information does not by itself purchase services, reserve project availability, or create a paid client engagement. The scope, fees, timing, responsibilities, and deliverables for an engagement are established in a separate agreement accepted by both parties.

If a client agreement expressly incorporates these terms by reference, they apply to that engagement only to the extent stated in the client agreement. The client agreement controls if there is a conflict. Unless that agreement states otherwise, the incorporated version is the version in effect when the agreement is accepted; later website updates do not automatically amend it.

Packages and website information

Service and package descriptions explain the types of work we offer. A final proposal or service agreement identifies the work included in your project, any applicable third-party costs, advertising spend, payment terms, and other commercial details. Request clarification before relying on a description for a particular project.

We aim to keep the website accurate and current and may correct errors or update descriptions and availability. Project timing depends on the final agreement.

Marketing results and case studies

Marketing performance depends on factors including market demand, competition, budget, creative materials, platform policies, the quality of an offer, and a client's sales process. Unless expressly stated in a separate agreement, we do not guarantee a particular search ranking, inclusion in AI-generated answers, number of leads, bookings, revenue, or return on advertising spend.

Case studies and testimonials describe particular experiences and reporting periods. Read the qualifications accompanying each example, including the source and definition of the metrics. Revenue, commissions, advertising spend, campaign-specific cost per lead, and profit are different measures. A result reported for one engagement is not a contractual commitment for another.

These terms do not override express website representations or limit rights that cannot lawfully be excluded.

Website content and intellectual property

Website text, design, photographs, videos, and other content are owned by Tiderunner or used with permission or under an applicable license. Client names, logos, trademarks, and other third-party materials remain the property of their respective owners. Displaying them does not transfer ownership or grant a license to reuse them.

You may view the website and keep reasonable copies for evaluating our services. Except as permitted by law or an applicable license, you may not republish, sell, or commercially exploit protected content without permission from the relevant rights holder. Ownership and licensing of work delivered to clients are governed by the applicable client agreement.

Acceptable use

Use the website lawfully and in a manner that respects others' rights. Do not submit malicious code, impersonate another person or business, send unlawful or infringing material, attempt unauthorized access, or interfere with the website's operation. Do not use the inquiry form for spam or deceptive communications.

We may reasonably restrict access to prevent misuse. These terms do not prohibit lawful reporting, legitimate criticism, or the exercise of nonwaivable rights.

Information you submit

Provide information that is accurate to the best of your knowledge and that you are authorized to share. Do not submit passwords, payment-card details, government identification numbers, client customer lists, or other sensitive information through the public inquiry form.

You retain any rights you have in material you submit. You permit us to review and use it to respond to your inquiry and discuss the requested services, as described in our Privacy Policy. Submitting an inquiry does not grant us ownership of your business materials or permission to publish them. Discuss any special confidentiality requirements before sending confidential project materials.

Third-party websites and platforms

Links to client websites, service providers, and other external resources are provided for information or convenience. We do not control their content, availability, terms, or privacy practices. Your use of those resources may be governed by their own terms.

Search engines, advertising networks, and AI platforms independently control their systems and policies. References to those platforms do not imply that Tiderunner controls them or is endorsed by them.

Availability and limitations

The website may be interrupted for maintenance, technical issues, or circumstances outside our reasonable control. To the extent permitted by applicable law, the website and its general information are provided as available, without warranties of uninterrupted availability, freedom from errors, or suitability for every particular purpose.

To the extent permitted by applicable law, Tiderunner is not liable for indirect or consequential losses arising solely from use of, or inability to access, this website. This provision does not exclude liability for fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded. It does not replace the liability provisions in a separately accepted client agreement.

Privacy

Our Privacy Policy explains how we handle website and inquiry information. These terms do not constitute consent to optional tracking or waive applicable privacy rights. Any consent required for a particular activity must be obtained through an appropriate separate process.

Governing law and changes

To the extent permitted by applicable law, these website terms are governed by New York law, without applying its conflict-of-law rules. This provision does not deprive anyone of protections that cannot lawfully be waived.

We may update these terms by publishing a revised version and changing the effective date. Changes apply prospectively and do not automatically modify an existing client agreement. If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
